These Terms of Service (“Terms”) govern your access to and use of the website www.aliceandhomer.co.uk and the services provided by Alice and Homer (“we”, “us”, “our”).

By accessing our Site or engaging our services, you agree to be bound by these Terms. If you do not agree, you must not use our Site or Services.

1. About Alice and Homer

Alice and Homer provides AI-powered content creation services, including but not limited to:

  • AI-generated content

  • AI avatars

  • Synthetic or cloned voices

  • Brand campaigns

  • UGC-style content

  • Creative and strategic support related to the above

All services are digital and custom-made.

2. Eligibility & Business Use

Our Services are intended primarily for business clients.

By using our Services, you confirm that:

  • You are at least 18 years old

  • You have authority to enter into a binding agreement on behalf of a business (where applicable)

  • All information you provide is accurate and lawful

3. Scope of Services

The scope, deliverables, timelines, and fees for Services will be agreed:

  • in writing,

  • via proposal, invoice, email, or onboarding documentation.

Any work outside the agreed scope may require additional fees or a revised agreement.

4. Client Responsibilities

You agree that you are responsible for:

  • Providing accurate briefs, instructions, and materials

  • Ensuring you have all necessary rights, permissions, releases, and consents for any content, data, likeness, voice, or brand assets supplied

  • Reviewing deliverables in a timely manner

Alice and Homer is not responsible for delays or issues caused by incomplete or inaccurate information provided by you.

5. AI Avatars, Synthetic Voices & Likeness

Where Services involve AI avatars, synthetic voices, or AI-generated representations of individuals:

  • You confirm you have lawful authority and consent to use any image, voice, or likeness provided

  • You retain responsibility for compliance with advertising, employment, and data protection laws

  • We do not reuse, resell, or train AI models on your data unless explicitly agreed in writing

6. Fees & Payment

All fees will be clearly stated before work begins.

Unless otherwise agreed:

  • Payment is required in full upfront

  • Work will not commence until payment is received

Late or non-payment may result in suspension or termination of Services.

7. Refunds & Cancellations

Refunds, cancellations, and credits are governed by our Refund & Cancellation Policy, which forms part of these Terms.

By engaging our Services, you confirm you have read and agreed to that policy.

8. Intellectual Property

Our IP

All tools, processes, workflows, prompts, templates, and methodologies used by Alice and Homer remain our intellectual property.

Client Deliverables

Upon full payment:

  • You receive a licence to use the delivered content for your intended business purposes

  • Ownership or usage rights will be as specified in your agreement

We reserve the right to showcase anonymised or approved work for portfolio or marketing purposes unless otherwise agreed.

9. No Guarantees or Performance Claims

Due to the nature of AI-generated content, marketing, and UGC-style assets:

  • Results are not guaranteed

  • Engagement, reach, conversions, or revenue outcomes are not promised

You acknowledge that creative and marketing outcomes depend on many factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, or economic losses

  • Our total liability is limited to the amount paid by you for the specific Services giving rise to the claim

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

11. Indemnity

You agree to indemnify and hold harmless Alice and Homer from any claims, damages, or losses arising from:

  • Your misuse of delivered content

  • Breach of these Terms

  • Failure to obtain required permissions or consents

  • Use of content in a way that violates law or third-party rights

12. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or commercial information shared during the course of Services, unless disclosure is required by law.

13. Termination

We may suspend or terminate Services if:

  • These Terms are breached

  • Payment obligations are not met

  • Unlawful or unethical use of Services is identified

Termination does not affect any accrued payment obligations.

14. Website Use

You agree not to:

  • Misuse the Site

  • Attempt to gain unauthorised access

  • Copy or scrape content without permission

We reserve the right to restrict access to the Site if misuse occurs.

15. Governing Law

These Terms are governed by the laws of Scotland.

Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
